Limited contract until 2020

I will complete 5 years in DK in August 2019 and I have contract until February 2020. Will I be affected by the new residency rules?

correct answer of your question would require some more information from you.

But since you have not provided us with this, we assume in our answer that you are a non-EU citizen.

As you probably know the requirement will be "only" 5 out of the last 12 years in 2019, and 6 out of the last 12 years in 2020.

The requirement must be met, on the day you apply for Unemployment benefits ("dagpenge")...So, as we see it you will be able to get benefits/meet the residence requirement, if you apply after august 2019 and until December 31, 2019. If you apply in 2020, the same will apply...you will meet the requirement if you apply after august 2020 and until December 31, 2020.

After august 2021, you will be able to apply for benefits/meet the requirement regardless of what time on year you apply.

I know this seems a little strange...that you will only meet the requirement in some months of 2019 and 2020.

However the new law text does not mention anything about this situation, so we have to wait and see how the A-kasse will treat a case like yours.

Another important thing you must consider, is if your work-permit allows you to stay and work in Denmark, also after the current contract ends, or you think you will be able to get a new/another work-permit after February 2020.

If not, then you will not be able to get dagpenge anyway...no matter if you meet the new residence requirement or not.

We recommend that you also ask your A-kasse.
