    I have a question regarding an address in Denmark before start of studies. I did not have a membership 1 year before the end of my education, therefore I am looking if I am entitled for the graduate rights.

    In “Conditions for graduate rights” it says:
    “You had a permanent address in Denmark no later than one day before the start of your education.”

    I can see that my first address was registered 19 days after the start of my education and that was because university was delaying the process so much, however, I was in Denmark already before my education start. Does this mean I am not entitled for unemployment benefits after my graduation?

    Hi,

    there is no formal requirement of an registered address.

    However you need to be able to prove for the A-kasse that you stayed/lived in Denmark at latest one day before the start of your eduaction. A tenant agreement or similar would be a fine proof.
    It’s also ok to stay with a friend if you don’t have your own address. The formal documents is not important. The important thing is that you actually stayed in Denmark.

    Hello again,

    another question regarding the new rules from May 1st: it says that certain level of Danish language needs to be achieved, however, it can be exempt if at least 600 working hours have been done during a 12 months period in last 24 months. Does internship count in those working hours or its only part time jobs that count?

    Hi,

    only wage hours that have been reported to SKAT (the income register) will count, when the A-kasse has to find out if you meet the affiliation requirement instead of the language requirement. It has to be paid hours.

    Only employment that follows a collective agreement (“Overenskomst”) or is otherwise carried out on ordinary pay and working conditions can be included. This means, for example, that your salary must not be too low. If your hourly wage is below DKK 132.19 in 2023, you must expect that the A-kasse will take a closer look at it.

    There must be no public subsidy for the salary.

    Also working hours/income from other EEA countries can be used as long as 150 out of the 600 hours is from an employment in Denmark, and also the last working hour must be in Denmark.

    Hi,

    I have an additional question regarding the 600 hours requirements. In July I received two payslips, one from my Danish employer and one for work i performed in another EEA Countries (roughly 100 hours). Although i have enough hours, Akadermikernes has rejected my application saying that if i want to use hours from another EEA country, i also need to work for subsequent 150 hours in Denmark, which is different from the requirement that the last working hour must be in Denmark.
    What is the correct interpretation?

    Additionally, in 2022 my employer didn’t pay me a few hours every month. Thanks to the support from my Union, I was able to prove it and in the end, i got the hours paid. However, these hours had been paid late and my A-kasse refuses to consider this fact when it comes to the 12months requirement. Do you have any suggestion?

    Hi,

    These are new rules that have been in force from 1 May 2023, and there is therefore no practice from cases yet on how the rules should be interpreted.

    However if you look at the law Act §31 (https://www.retsinformation.dk/eli/lta/2023/107) and also the guidance to the Act §31 (https://www.retsinformation.dk/eli/retsinfo/2023/9062) it states that:

    “It is a condition for combining periods of employment that the person most recently had employment in Denmark. It is therefore a condition that a full-time insured member who must combine periods of employment from another EEA country, Switzerland or Great Britain, has had 150 paid hours in Denmark within the last 24 months and after returning to Denmark.”

    We read this as the 150 hours of work in Denmark can be performed over two periods…for example before and after work in another EEA country…but the last hour(s) of the 600 hours work must be performed in Denmark.

    “Min A-kasse” says the same on their website as we do: https://min-a-kasse.dk/din-situation/nyuddannet/.

    As mentioned we still need some practice from complaints. But you could complain about the answer from Akademikernes A-kasse. If you do that, then your case will be assessed by the Authority for A-kasser in Denmark (star.dk).

    About your second question:

    You dont tell us the reason why Akademikernes A-kasse refuse to count the hours.

    But remember that only employment that follows a collective agreement (“Overenskomst”) or is otherwise carried out on ordinary pay and working conditions can be included.

    It could be the reason why they refuse to include them in the 12 months requirement.

    Tusind tak for the answers. Regarding the complaint, should i inform directly my A-kasse or shall i complain directly at star.dk?

    Regarding the second question:

    I am sorry I have not explained myself properly. They accept the hours, but refuse to consider the delays in the payment, therefore counting as an extra mont.

    Hi,

    You must send your complaint to your A-kasse, after which they must forward it to star.dk.

    Regarding your second question:

    I still don’t think I fully understand what the problem is…can i see exactly what the A-kasse writes to you about this?. Do they refer to a legal Act.
